A woman's right to a safe legal abortion in South Africa conflicts with a health care professional's freedom of conscience. Conscientious objection or treatment refusal on the basis of conscience may be protected by the constitution but its morality has not been explored. This study uses Kantian Deontology to elucidate the ethical duties of health care professionals based on the Physician's Pledge. It concludes that conscience is morally empty and that health care professionals have a duty to treat all patients (...) equally irrespective of the condition they present. Drawing on Kantian promise keeping, the study also concludes that health care professionals should place patients health and wellbeing above all other considerations. Using the categorical imperative, the study shows that health care professionals have a perfect duty not to refuse treatment. The study recommends that conscientious objection be rejected in all circumstances except where the psychological wellbeing of the health care professional will be affected. This can be achieved through legislative and professional body regulation of conscientious objection. (shrink)

Sumner B. (Barney) Twiss, who died in 2023, was for ten years a General Editor of the Journal of Religious Ethics (JRE). He was a frequent contributor of articles, a member of the JRE Editorial Board, and a member of the journal's Board of Trustees. In this article, colleagues and students reflect on some of his many contributions, not only to the JRE but to the broader discursive fields of comparative religious ethics and human rights.

In this paper, I argue for the permissibility of torture in idealized cases by application of separation of cases: if torture is permissible given any of the dominant moral theories (and if one of those is correct), then torture is permissible simpliciter and I can discharge the tricky business of trying to adjudicate among conflicting moral views. To be sure, torture is not permissible on all the dominant moral theories as at least Kantianism will prove especially recalcitrant to granting moral (...) license of torture, even in idealized cases. Rather than let the Kantian derail my central argument, I directly argue against Kantianism (and other views with similar commitments) on the grounds that, if they cannot accommodate the intuitions in ticking time-bomb cases, they simply cannot be plausible moral views—these arguments come in both foundationalist and coherentist strains. Finally, I postulate that, even if this paper has dealt with idealized cases, it paves the way for the justification of torture in the real world by removing some candidate theories (e.g., Kantianism) and allowing others that both could and are likely to justify real-world torture. According to the algebraic approach to spacetime, a thoroughgoing dynamicism, physical fields exist without an underlying manifold. This view is usually implemented by postulating an algebraic structure (e.g., commutative ring) of scalar-valued functions, which can be interpreted as representing a scalar field, and deriving other structures from it. In this work, we point out that this leads to the unjustified primacy of an undetermined scalar field. Instead, we propose to consider algebraic structures in which all (and only) physical fields are (...) primitive. We explain how the theory of natural operations in differential geometry—the modern formalism behind classifying diffeomorphism-invariant constructions—can be used to obtain concrete implementations of this idea for any given collection of fields. For concrete examples, we illustrate how our approach applies to a number of particular physical fields, including electrodynamics coupled to a Weyl spinor. (shrink)

A new model of scientific explanation is proposed: the covering theory model. Its goal is understanding. One chooses the appropriate scientific theory and a model within it. From these follows the functioning of the explanandum, i.e. the way in which the model portrays it on one particular cognitive level. It requires an ontology and knowledge of the causal processes, probabilities, or potentialities (propensities) according to which it functions. This knowledge yields understanding. Explanations across cognitive levels demand pluralistic ontologies. An explanation (...) is believed or only accepted depending on the credibility of the theory and the idealizations in the model. The Health System Food and Nutrition Units are designed to produce and offer balanced meals, establishing dietary patterns, maintaining and restoring the health of the individual. The control of dirty in leftover ingestion can lower costs and organic waste. The objective of the study is to quantify and analyze the leftover intake i meals served to patients, and ingestion of dirty leftovers in collective meals of a Food and Nutrition Unit, located in the Southwest of Paraná. The data were collected (...) in two weeks, being developed in two stages. The first was the determination of the leftover ingestion and dirty remains of the healthy collective, and the second quantification of the rest intake by the patients community. Two scales were used to obtain the total weight of the food distributed in the cafeteria. Vats were weighed, before and after lunch. The garbage bags were weighed in order to quantify the leftover ingestion. The results of total leftovers showed an average of 44.71 kg / day, with a percentage of 44.19% being unacceptable. The leftover intake presented 8.72%, being classified as bad with this waste331 people could be fed. In order to measure the leftover intake by the diseased community, the weights of three lunch boxes were collected; the number of boxes wss added, resulting in kilos of food distributed for the day. Weighing the bags of garbage, was 19.02 kg / day, representing 28.36% of leftover ingestion, being above the acceptable of up to 20%. Based on this data, 148 people could be fed, making it necessary to take in consideration organoleptic criteria, satisfaction surveys, their preferences and nutritional needs, both for the healthy and the diseased group. There are a range of ethical issues that confront physicians in times of war, as well as some of the uses of physicians during wars. This book presents a theoretical apparatus which undergirds those debates, namely by casting physicians as being confronted with dual-loyalties during times of war. While this theoretical apparatus has already been developed in other contexts, it has not been specifically brought to bear on the ethical conflicts that attain in wars. Arguably, wars thrust physicians into ethical (...) conflicts insofar as these wars create a tension between a physician's obligation to heal and an obligation to serve some other good (e.g., military chain of command, national security, the greater good, etc.). Alternatively, we can debate whether this conception is appropriate. For example, one could argue that that non-medical duties cannot attach to physicians (e.g., due to nonoverlapping spheres of justice), thus abrogating the dual-loyalty challenge. Or else one could argue that these medically-trained personnel do not act qua physicians at all (but rather partisan advocates) and therefore duties that would otherwise attach to physicians do not attach here. In the first part of this book, these issues are debated. In the second part of the book, the dual-loyalities frame is used to explore various substantive debates that obtain when the military makes use of physicians. Physician involvement in torture is a heated topic, and certainly the most visible element of the debate. Also, however, we could use the dual-loyalties framework to explore issues in other arenas, such as: development of chemical and biological weapons, medical neutrality/battlefield triage, and so on. In each of these cases, the same tensions arguably exist: physicians have duties both to their patients and elsewhere (which, depending on the details of the view, could be any of the above-mentioned ends). Esse tema partiu de uma perspectiva ecofeminista sobre um aparente conflito entre alguns pontos da filosofia de Schopenhauer: 1) a influência de Kant sobre sua obra, 2) as evidências de machismos e, curiosamente, 3) a sua utilização por filósofos contemporâneos para pensar uma ética animal ou ambiental. O primeiro ponto, baseado em críticas à tradição moderna, sugere que Schopenhauer seja leitor (...) de uma teoria antropocêntrica. O segundo não permite ignorar que a realização de sua filosofia produz pelo menos um tipo de desigualdade. E o terceiro sugere, no sentido de diminuir os sofrimentos político-ecológicos tão presentes na atualidade, uma ética que atribui um mesmo valor moral à toda natureza ou pelo menos a todos os animais, inclusive humanos. Evolutionary ethics has a long history, dating all the way back to Charles Darwin.1 Almost immediately after the publication of the Origin, an immense interest arose in the moral implications of Darwinism and whether the truth of Darwinism would undermine traditional ethics. Though the biological thesis was certainly exciting, nobody suspected that the impact of the Origin would be confined to the scientific arena. As one historian wrote, 'whether or not ancient populations of armadillos were transformed into the species that (...) currently inhabit the new world was certainly a topic about which zoologists could disagree. But it was in discussing the broader implications of the theory...that tempers flared and statements were made which could transform what otherwise would have been a quiet scholarly meeting into a social scandal' (Farber 1994, 22). Some resistance to the biological thesis of Darwinism sprung from the thought that it was incompatible with traditional morality and, since one of them had to go, many thought that Darwinism should be rejected. However, some people did realize that a secular ethics was possible so, even if Darwinism did undermine traditional religious beliefs, it need not have any effects on moral thought.2 Before I begin my discussion of evolutionary ethics from Darwin to Moore, I would like to make some more general remarks about its development.3 There are three key events during this history of evolutionary ethics. First, Charles Darwin published On the Origin of the Species (Darwin 1859). Since one did not have a fully developed theory of evolution until 1859, there exists little work on evolutionary ethics until then.4 Shortly thereafter, Herbert Spencer (1898) penned the first systematic theory of evolutionary ethics, which was promptly attacked by T.H. Huxley (Huxley 1894). Second, at about the turn of the century, moral philosophers entered the fray and attempted to demonstrate logical errors in Spencer's work; such errors were alluded to but never fully brought to the fore by Huxley. These philosophers were the well known moralists from Cambridge: Henry Sidgwick (Sidgwick 1902, 1907) and G.E. Moore (Moore 1903), though their ideas hearkened back to David Hume (Hume 1960). These criticisms were so strong that the industry of evolutionary ethics was largely abandoned (though with some exceptions) for many years.5 Third, E.O. Wilson, a Harvard entomologist, published Sociobiology: The New Synthesis in 1975 (Wilson E.O. 1975), which sparked renewed interest in evolutionary ethics and offered new directions of investigation. These events suggest the following stages for the history of evolutionary ethics: development, criticism and abandonment, revival. In this paper, I shall focus on the first two stages, since those are the ones on which the philosophical merits have already been largely decided. The revival stage is still in progress and we shall eventually find out whether it was a success. (shrink)

Humanism and the Death of God is a critical exploration of secular humanism and its discontents. Through close readings of three exemplary nineteenth-century philosophical naturalists or materialists, who perhaps more than anyone set the stage for our contemporary quandaries when it comes to questions of human nature and moral obligation, Ronald E. Osborn argues that "the death of God" ultimately tends toward the death of liberal understandings of the human as well. Any fully persuasive defense of humanistic values - including (...) the core humanistic concepts of inviolable dignity, rights, and equality attaching to each individual - requires an essentially religious vision of personhood. Osborn shows such a vision is found in an especially dramatic and historically consequential way in the scandalous particularity of the Christian narrative of God becoming a human. He does not attempt to provide logical proofs for the central claims of Christian humanism along the lines some philosophers might demand. Instead, this study demonstrates how philosophical naturalism or materialism, and secular humanisms and anti-humanisms, might be persuasively read from the perspective of a classically orthodox Christian faith. Conversational negation often behaves differently from negation as a logical operator: when rejecting a state of affairs, it does not present all members of the complement set as equally plausible alternatives, but it rather suggests some of them as more plausible than others (e.g., “This is not a dog, it is a wolf/*screwdriver”). Entities that are semantically similar to a negated entity tend to be judged as better alternatives (Kruszewski et al., 2016). In fact, Kruszewski et al. (2016) show that (...) the cosine similarity scores between the distributional semantics representations of a negated noun and its potential alternatives are highly correlated with the negated noun-alternatives human plausibility ratings. In a series of cloze tasks, we show that negation likewise restricts the production of plausible alternatives to similar entities. Furthermore, completions to negative sentences appear to be even more restricted than completions to an affirmative conjunctive context, hinting at a peculiarity of negation. (shrink)

Ever since its beginning, Christianity ascribed an important role to care for bodily and psychic suffering. Up to modernity, psychological assistance was closely connected with theology. In modern times, philosophy and theology began to distance themselves from metaphysics and transcendence, thus opening the path for a purely psychological interpretation of religion and of religious life (cf. Kant, Schleiermacher). The founders of important psychological schools (Sigmund Freud, Carl Gustav Jung, Erich Fromm, Fritz Perls, and Carl Rogers) offered purely naturalistic interpretations (...) of the human condition and discounted transcendence. Today, pastoral psychology is situated in a field of tension between a purely naturalistic psychology and openness to a spiritual dimension and to man’s vocation for transcendence. What those recent psychological schools contribute is important for a deeper understanding of man, but it remains merely partial as long as his spiritual dimension is disregarded. (shrink)

Taking the pioneering and yet belated work Saturn and Melancholy (1964) of Erwin Panofsky, Fritz Saxl, and Raymond Klibansky as its starting point, this article situates melancholy as at once its own, often local and non-specialist discourse as well as a conceptual web binding together medical, artistic, and social innovations, competitions, and turmoil. As a subject, melancholy demands interdisciplinary study, as Dürer’s print (...) Melencolia I continues to prove. As a locus of methodological innovation, melancholy in the wake of Panofsky, Saxl, and Klibansky continues to yield the alternative genealogies, conceptual histories, and formal artistic vocabularies of this volume’s contributions whether moving backwards from Dürer to Homer or forward to the present day with Lars von Trier and major European novelists. The fact that pure chemicals are called “substances” in English (and closely related words are so used in other European languages) derives from philosophical compromises made (...) by grammarians in the late Roman Empire (particularly Priscian [fl. ~520 CE]). When the main features of the constitution of isotopes became clear in the first half of the twentieth century, the formal (IUPAC) definition of a “chemical element” was changed. The features that are “essential” to being an element had previously been “transcendental” (“beyond the sphere of consciousness”) but, by the mid-twentieth century the defining characteristics of elements, as such, had come to be understood in detail. This amounts to a shift in a “horizon of invisibility” brought about by progress in chemistry and related sciences.
